Illegals and job related accidents, who is responsible?

If your child used his big brothers Id and was hired by a construction company and got a nail through their head would you hold the company responsible for not validating the Id given to them at hire? Or would you pay the medical costs and blame your child for misrepresenting themselves?

Who pays the medical costs your child or the company?

  1. Workman's comp covers job related injuries. And I'm sure there is  a lawyer somewhere who would represent the child to sue the employer.

E-verify is mandatory in some states, but not all. I wonder why?

Could they be using illegals under the table to boost their profits?

The Federal Government has their laws, but state are able to make their own laws to suit their citizens.

  2. Yes it should be mandatory.

  3. Yes it should!

Most Americans do not understand that when the Mexican Government is after someone, they generally make a run for the border.  Once they get here, they get a job and wait till everything cools off.  Once it has cooled off, they do a job here and go south with the loot, or satisfaction.  Put e-verify in the process and it stops that criminal cold.

But it also stops fraud.  We currently have 300 billion in expenditures for illegal aliens and if we stop the fraud, we can use the money to get all those people Microsoft wants educated, educated, and they will be American Citizens.  300 billion, and that is only part of it.

  4. ABSOLUTELY!

The wrong doer, the "child" could be held responsible in a court of law for his own error/law breaking. In fact, if the child is under age, YOU yourself could be held responsible to pay the fees associated with the child breaking the law and hurting himself. YOU get to pay.

Most likely, the insurance company who bonds the construction company will pay for medical.

In all likely hood, this sort of stuff can easily go into litigation which is very expensive for ALL involved ..INCLUDING the expense by the State/Feds to keep a court system up and running.

You don't say the child, his brother or you are illegals ...but it seems implied. Without a big harang about it ...if that is the case, this sad situation is ONE MORE example of why illegal entry into this country can not and should not be allowed.

If all involved were legal, this situation would still be messy but it would be a bonified, covered, anticipated kind of possible that would likely be comvered by insurance and it's agreements with the construction company and how the law requires that company to protect the taxpayers as well as it's workers and consequently, itself from damages due to accidents.

  5. Yes it should.
