Question:

Should we have gotten a breathalyzer after a pile up...or authorities have taken pictures?

We were in a pile up, I was driving my suv with trailor attached, when sudenly my trailor lost control (ice on road). I gained control and ended up in middle of freeway, my suv ended up on the right lane and trailer on the left lane(2 lane freeway, one way). My suv was facing opposite flow of traffic in right lane, then semi hit drivers side of suv, I end up in the middle of his left side box, then 10 second after the accident a pick up truck hits my trailer, (should the truck driver have gotten a ticket because they couldn't safely stop without hitting my trailer under the same conditions that I got the ticket, my ticket was for unsafe speed under icy weather condition.)

No one was checked to see if we were under the influence, is that okay.

  1. Why are you trying to blame some one else for your mistake? You are clearly at fault for not being able to control your vehicle. The other drivers would most likely not have had a problem if you weren't blocking the free way.

As for taking pictures? Why didn't you take any? It is not the responsibility of law enforcement to take them for you.

  2. If the other drivers where not swaying, had the smell of alcohol on their breath or was speaking with slurrs, then there would have been no good reason for the officer to give the driver or drivers a Breathalyzer. The accident was clearly your fault. There would be no need for the truck driver to get a ticket. You were on the opposite side of the freeway. Well, I hope that everyone was okay and good luck with this case.

  3. Did cops show up and talk to you?  Then they checked you :) they just didn't do it with a machine.  The same can probably be said of the other drivers.

The trailer didn't lose control.  You lost control of the trailer.  Not because of ice, because you didn't account for ice.  Feel free to pretend it was fate someow, but really you were driving beyond your skill level.  Up your skill level.

  4. If the truck was driving the opposite direction, he doesn't get a ticket because you entered his lane.  It isn't the same as a tail-gater not being able to stop.

  5. I would say they should have gotten in trouble for not controling their speed and paying attention.  Really!  I am not so sure they should have gotten a breathalizer but if it looked like they were under the influence then yes.  Did they give you the breathalizer?  I think if you got introuble for failure to control speed concidering the weather conditions so should they.
