Betfair did not bring the case.  They reported suspicious betting patterns to the HRA - by the way no one has disputed that these bets were of a suspicious nature.  The HRA then investigated the case further before passing it to the police who then passed it to the CPS and the cahrges were brought by them.

The case was Fallon v. the Crown, not Fallon v. Betfair.
