  1. Dawn.....stop looking at stupid videos and demanding that everyone else look at stupid videos.....if you want to see the tax law, surf or go to the library and educate yourself......if you're interested in tax law, take a college course on tax law and ask the professor your questions....if you want someone in authority to answer your arguments, there are many many many many people who have brought suit and lost - you can read all their arguments by reading the court cases.  And if, after all this, you still believe that's it's illegal or immoral, yada yada yada......bring you're own court case and explain it to the judge.

Here's something the a court has already said to most of your arguments:

"We perceive no need to refute these arguments with somber reasoning and copious citation of precedent; to do so might suggest that these arguments have some colorable merit. The constitutionality of our income tax system—including the role played within that system by the Internal Revenue Service and the Tax Court—has long been established... [Petitioner's argument] is a hodgepodge of unsupported assertions, irrelevant platitudes, and legalistic gibberish."

Translation:  we don't have the time or the patience to listen to this c**p all day

  2. I guarantee if you do not pay you will see the inside of a Federal prison!

  3. The movie "Freedom to Fascism" is inaccurate, conspiracy theory nonsense.I suggest you go to http://evans-legal.com/dan/tpfaq.html and lookup almost every point in the film. I also recommend that you try and verify different quotes from the film from RELIABLE websites.

Article 1 Section 8 of the U.S. Constitution states, in part, "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises,..."

Income taxes are legal under the Constitution because income taxes are INDIRECT taxes in a Constitutional sense. In HYLTON v. U S, 3 U.S. 171 (1796), a Supreme Court that included at least two of the original framers of the Constitution, Justice Samuel Chase stated, "...the direct taxes contemplated by the Constitution, are only two, to wit, a capitation, or poll tax, simply, without regard to property, profession, or any other circumstance; and a tax on LAND."

In 1861, the first income tax law in the U.S. was passed. In Springer v. United States, 102 U.S. 586 (1880) (A Supreme Court case), the court had to consider whether an income tax on an individual was constitutional. The court stated, "Our conclusions are, that direct taxes, within the meaning of the Constitution, are only capitation taxes, as expressed in that instrument, and taxes on real estate; and that the tax of which the plaintiff in error complains is within the category of an excise or duty." Springer was the plaintiff in error. The Supreme Court upheld the constitutionality of the income tax law that was in effect in 1865.

In 1895, the Supreme Court did declare unconstitutional an income tax on income earned from personal property (i.e. rental income).  That same Supreme Court decision declared that a tax on income earned as a wage WAS constitutional.

After the ratification of the 16th amendment, the Supreme Court in STANTON v. BALTIC MINING CO, 240 U.S. 103 (1916) stated, "...by the previous ruling it was settled that the provisions of the 16th Amendment conferred no new power of taxation, but simply prohibited the previous COMPLETE AND PLENARY POWER OF INCOME TAXATION POSSESSED BY CONGRESS FROM THE BEGINNING from being taken out of the category of indirect taxation to which it inherently belonged..."

BTW, the Bureau of Internal Revenue, which later became the IRS, was established in 1862.

The current income tax laws are codified as Title 26 of the U.S. Code.  You can read it at http://uscode.house.gov/download/title_2...

To read the actual laws passed by Congress and signed by a President, you have to go to the U.S. Statutes at Large.  For the most part, these are not available online.  However, you can read them in most Federal Depository Libraries and most law libraries.  Go to Volume 68A, starting on page 3 to read the Internal Revenue Act of 1954.  Then go to Volume 100, starting on page 2085 to read the Tax Reform Act of 1986.  Those two laws form the basic structure of the current income tax laws.  Various acts passed in the years since have modified those two laws to give us the current state of the income tax laws.

The book, "The Law that Never Was" by Bill Benson has been completed refuted. Also, no court has EVER accepted any of the arguments brought forth in that book. Here is a court case that discussed the book. In U.S. v. Thomas, 788 F.2d 1250 (7th Cir. 1986), cert. den. 107 S.Ct. 187 (1986).

You can read it at http://bulk.resource.org/courts.gov/c/F2...

Especially read paragraphs 4 through 6.

Judge Fox's statement was in the context of giving an example. He was not making a statement of fact. The comments made by Judge Fox were made in passing, without judicial review, and in a case that had nothing to do with the 16th amendment. In the end, the Judge also said that he didn't think any court would ever set it aside.

The Federal Reserve act was properly passed by Congress and does not require a Constitutional amendment. While the Federal Reserve Act was passed on Dec. 23, 1913, according to the Congressional record, the bill passed the house by a count of 298 to 60. 358 members voted out of 435, that's pretty good attendance. That's probably better attendance than the current House of Representative gets on most days. The Senate passed the bill with a vote of 43 to 25. That's 68 members voted out of 96. Again, that is good attendance.

The quote by Woodrow Wilson that the film says he made in 1919 is false. First, there is no record anywhere that Woodrow Wilson said the first part of that quote. The rest of the quote is taken from Woodrow Wilson's book, "The New Freedom". However, "The New Freedom" was published in 1913! Also, the book is actually a compilation of speeches he made on the campaign trail during 1911 and 1912. He was really discussing corporate monopolies and not the Federal Reserve (which didn't exist yet) or the banks. You can read "The New Freedom" for yourself at http://www.gutenberg.org/etext/14811

The Federal Reserve is independently audited every year. Those audits and more are part of the Federal Reserve annual report to Congress.

Look at all I have written refuting many points in the movie, "Freedom to Fascism" and that's only the first five minutes of it.

There are many more quotes in the movie that are taken completely out of context and there are many claims in the movie that are just plain wrong.

Sherry Peel Jackson, one of the people interviewed in the movie was tried for willful failure to file and tax evasion on Oct. 29 and 30, 2007. GUILTY on all counts. She was sentenced to four years in prison and SHE STILL HAS TO PAY HER TAXES.

A few people have successfully beaten criminal charges, but that doesn't mean there isn't a law any more than O.J. Simpson's acquittal means there isn't a law concerning the murder of your ex-wife.  In fact, and this is important, in order to be charged with breaking a law, THERE HAS TO BE A LAW TO BE BROKEN!

To summarize, there is a law concerning income taxes, it is Title 26 U.S.C. If you earn more than the standard deduction, you must file tax returns. Wages from a job are income. Income is NOT limited to corporate profits. The Federal Reserve is not some great conspiracy. etc. etc.

  4. The scandel you are hearing of is somewhere in the tax law it says something to the effect.

You must pay taxes on all income earned outside the US.

Some people take this as to mean you do not pay taxes inside the US, which is clearly a backwards way of thinking.  Nice try though.

  5. Don't pay your taxes and call the IRS and tell them you refuse to pay. They will be more than happy to show you the laws that say you have to pay. And these laws are legally binding based on the 16th Amendment; "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration."

And, no where in the 16th Amendment does it say it is only for corporations. It does, however, state that they can collect taxes on "...incomes, from whatever source derived".

So, pay your taxes or don't pay your taxes. Me, I want to stay our of jail, so I'm paying mine. If you think you don't have to, then don't. Just be prepared to suffer the consequences if you are wrong.

  6. I told you an hour ago 16th amendment. There is none so blind.....

    Next post please.

  7. 16th Amendment....that is the mechanism the government uses to enforce income tax law.

    http://en.wikipedia.org/wiki/Sixteenth_A...

The courts have interpreted the Sixteenth Amendment as standing for the rule that the Amendment allows a direct tax on "wages, salaries, commissions, etc. without apportionment."[28]

  8. The government is like the mafia. You are better off owing a bookie than the IRS with their penalties and interest. They will seize your house, car and bank accounts. The Liberals have more sympathy for people who don't pay taxes than for those who work 60 hours a week. I cannot comprehend what goes through their minds. It's as if they believe successful people don't pay taxes. They throw around the word "loophole" as if they know what they're talking about.

Thumbs down, as usual. No clue. I hope you make 150K someday and realize you are not better off after taxes. It's a fact. We live in socialism now, and the Left wants even more. They will never understand it until they live it, so I hope you work your tail off and make some money. You'll see.

  9. http://frwebgate.access.gpo.gov/cgi-bin/...

This is Title 26 of the United States Code, Federal Law and it shows you the tax imposed for Individuals.  The entire Title 26 of the United States Code SAYS THAT INCOME TAXES ARE LEGAL AND ARE TO BE PAID TO OUR GOVERNMENT.  IT IS FEDERAL LAW.

  10. Do you not see something odd about carrying on an argument by posting new questions?

This "video" you're referring to is an OLD, OLD urban myth.

    You have to pay taxes.

If you don't, you go to jail.

    It's that simple.

  11. The 16h gives congress the authority to tax income, but if you are looking for a statute that says one must pay, there isn't one.  Similarly, in my state, there is no statute that says one may not commit murder.  Instead, there are statutes that say what should happen if one does commit murder, just as the federal code has statutes that say what happens if one doesn't pay taxes.  Furthermore, even if you had a valid argument it doesn't matter because all the courts that have considered it have rejected it.  You have the right to disagree with court rulings, and feel they are wrong, but the judicial power of the United States is vested in the judiciary, not in the people.  Those that refuse tend to be imprisoned.  Of course you can feel wrongly imprisoned, as does every other prisoner, but that feeling does not help much.

  12. The person who 'offered' this has been shown the law a thousand times, but refuses to accept its validity.

The law is Public Law 99-514, as amended, which in its current version can be found at 26USC.

The government is authorized to apply such a law by the 16th Amendment, and 99-514 is the law by which they have done so.

Where on earth do you get the bizarre idea that the 16th Amendment is only for corporations? The language is perfectly clear. "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration."

What part of "...from whatever source derived" is that that you don't understand?

The legislative history of the amendment also makes it crystal clear that the intent was to remove any question as to whether *personal* income taxes were legal. Congress passed the 16th Amendment after conflicting court rulings on the Constitutionality of personal income taxes, and the text of the debates makes it clear that it was those *personal* income taxes that they were addressing.

    Richard

  13. You know what?  Don't pay your taxes, don't file a federal tax return, don't do anything.  Please, I'm begging you.  That way you'll get thrown in prison for tax evasion and we won't have to listen to you ignore the law when it's given directly to you.

Rick, thanks for giving the correct answer.  Hopefully that'll end this conversation.

I see this genius is going to give thumbs down to anyone who doesn't say "Oh, paying taxes is illegal, don't do it!"  Stupid poster is stupid.
