You can sue the store, but then there will be a huge invasive investigation done by the store to see what your stool was like afterwards, and if you're on any medication, and if your parents suffered from any food allergies. It will go on your history and lots of companies won't hire you. Then, if something actually bad happens to you, this will show up in your legal records, and a judge will feel you are frivolous

yes, you can sue the store, the manufacturer and every one in the chain. this can be a 1-warranty, 2-negligence and 3-strict liability case, but that is all law school theory.

will you win is another question. you have to prove your case (ie the jerky made you sick). do you have any medical records. for the same token, you need damages bc this is not a punitive case.

NO  !!!! ...I ate raisins and didn't look at what I was eating. After 3 hand fulls I look down and there were maggots in the can. I wrote to Sun Dry with the complaint and they sent me a coupon for a free package of raisins. If you like beef jerky I write the company you might get some more jerky.

how sick?  people can get upset stomach from anything bought anywhere, so I don't know how seriously they can take the claim.

If you can prove that you got food poisoning from thier neglegence and not your poor cooking hygiene, then you should get a very good sue case.

was it in a clear container where you just buy a few strips and pay for it? If so Yes.

If it was prepackaged and has a date on it it they are at some fault if it went bad but probably throw it out of court ,Because they will say did you look at the expiration date.

No, not unless the store it was purchased at made the beef jerky. You must be able to prove the jerky made you sick, and then go after the company that made it. You'll need the packaging it came in, the date, and store you  bought it at. And that's just for starters. Good luck and be thankful your healthy enough to get on the computer to ask this question.
