  1. There is a very strict, set procedure for making a worker redundant. If you feel you have been made redundant because of your sickness record, this may be seen as unfair selection and therefore, you may be able to claim unfair dismissal. However, if all procedures have been carried out properly by your employer, then yes, you can be made redundant while you are off sick.

You may need to take advice from a specialist employment adviser at the CAB (you can find your nearest one on the link below too) or you can contact ACAS. Website link below.

  2. no

  3. I googled "can I be made redundant whilst on sick leave". Lots of sites come up, including Citizens Advice, all of which have various examples from people asking that question. It looks as though they can make you redundant, but must have a proper process. They can't just decide to get rid of you and call it redundancy. They would need to follow a proper process of redundancy. They also would not be allowed to fill your post - as it is the post that is redundant. It's probably worthwhile contacting your line manager, or, if you don't find him or her approachable, try to speak to somebody in your workplace who might be able to update you on things. I hope it all works out well for you, as I've been made redundant in the past, and it's not nice.

  4. When your employer has to make people redundant then he must set out clear criteria for choosing who becomes redundant. These criteria must be fair and reasonable and justified. Sickness will not satify these conditions but being sick does not exclude you from redundancy if you meet the stated ctiteria.

If you have a union then look up their website. Otherwise try the links below.
