Simple Rear End Colision but they want to do a percentage to get out of it?

What would you say to a persons insurance company that says they want to do a percentage after being hit head on in a simple rear end collision?

The guy wasn't paying attention and I don't want to get blamed for being rear ended cause he hit me I didn't hit him.

  2. Apparently there is more to it than a simple rear end collision. Since we don't have any details of the accident - have not seen the police report - spoken to all drivers/witnesses, seen the damage to the vehicles - we are not in a position to really comment on the liability. We also don't know what state this happened in - and that has a lot to do with how it is handled.

    Therefore - if you have collision coverage - you can file with your carrier. Your insurance company will do it's own investigation and if they believe the other driver is at fault - they will subrogate back against his carrier to get paid back for their money and your deductible. If the other company does not want to pay 100% and both companies are members - they can file with Arbitration Forums.

  3. Don't understand the question.  How can you be rear ended and hit head on at the same time?  

  4. you tell them you want it fix and you want it fix right you go to three places for repairs and you tell them to pick one... they dont like it you tell them your will talk with your lawyer and see what he tells you to do

If it actually were a simple rear end, 100 per cent his fault accident, they wouldn't be assigning you a percentage of the blame.  What did you do?  Did you switch lanes immediately in front of him and then stop short?  There's something you aren't telling up, and without all the information we can't give you a definitive answer.
