my sister was hit today by a teen in a porsche and she fractured her arm and collar bone what can we do legally thanks

  1. Is her car insured? I would hope anybody that would let their teen have a porsche would have insurance. If so, the insurance should cover it, if not, your sister has a legitimate lawsuit against the teen's parents and should talk to a lawyer.

  3. Actually, the best part is to see a lawyer to see if you can collect damages for the accident.

    But it depends on the way the person hit the lady.

    If the person purposely hit that lady, the police can cite and/or arrest him on a lower charge...striking a pedestrian, or a higher felonious charge, vehicular assault.

    In most states, leaving the scene of an accident is against the law, and if that person did it, you also have leeway in filing criminal charges.

    But if the police think no criminal charges can be filed against the person, you can still sue for civil damages for pain and suffering, and for medical bills, but it depends on the "aggravating circumstances" or "mitigating circumstances" of the offender involved....for instance, did the offender hit you on purpose, or did he see the lady before he got a chance to put on the brakes (he saw her too late).

    If the driver is legally drunk, you have a lot more leeway......you can see the offender in court and you can hire a prosecuting attorney to likely find the defendant guilty of DUI or DWI. Conviction of DUI generally means at least 6 months to a year in jail and usually automatic taking-away (revocation) of one's drivers license for at least a year.
