Sleep Disabilty in school?

I am on a IEP, I have been diagonosed with ADD, OCD, and bipolar. I take medication(Zoloft 100mg) which makes my sleep patterns eradicate. I often do not get up to go to school until 9(I have to be on the bus at 7:10 AM, school starts at 7:45 AM) because my alarm and phone calls don't wake me up. Every time I'm late I have to serve a 2-hour detention on Friday. I can get a doctor to call in and claim these are medication related, however the school has said flat out "We don't care." I do know a little about IDEA, and ADA and I don't think this is legal. Is it legal and if not please cite laws. Thanks a ton.

  1. They don't have to care about it unless it is in your IEP.  Your IEP can be modified where school does not begin for you until second period or so.  It will start at a set class time.  You need to ask for a modified day and have a letter from your prescribing physician supporting your reasons to begin school late.


  2. They must accomodate your disability and its treatments-

    a shortened school day is appropriate-

    you need to have this included in your IEP (variation of attendance requirement)

    and your class schedule needs ro be adjusted according--

    also have you considered a 504 plan instead of an IEP-you may not need the extensive services of special ed-and only the accomodations throguh a 504 plan-

    It does sound as if you fit into the Other Health Impaired Category, but schools often neglect to explore the 504 plan option.
