Question:

Slightly Morbid Question for a Story...?

If a person was involved [though not totally responsible] in a car accident that resulted in an other person's death, would there be any type of prosecution for this? [I.e. would the person have to go to court or recieve any type of punishment?]

What if the person was responsible for the accident? What would happen then? [Assuming the accident is not the product of drunk driving]

We're working on stories for creative writing class, so I had a few questions for continuity.

Thank you.

  1. if the person was in no way responsible for the crash (meaning, the person that died was at fault), he would get no prosecution.

if he was responsible, he would get charged with vehicular manslaughter.

  2. Vehicular manslaughter charges are often filed in combination with other charges such as drunk driving(DUI) and/or reckless driving.

The particular circumstances surrounding the incident determine whether vehicular manslaughter is charged as a misdemeanor or felony crime.

Depending on the degree of the charges, a person accused of vehicular manslaughter may face a wide range of penalties including jail time, restitution to the victim's family, and more.

  3. UK has manslaughter, one down from murder, dangerous driving / driving without due care and attention..all for which prison time* can be served, also the deceased person's family can bring private prosecution for financial reward.

    * time also depends on previous convictions, driving whilst uninsured/banned etc...lots of room for creativity there!
