Question:

Small Claims Court - Next Step To Recover Money?

I'm a self employed tiler and recently completed a job which the customer has not paid for. I went online and made a claim on the HMCS website and judgement has been issued against the customer this week.

Just wondering, should I now wait to see if they respond or issue a warrant immediately to try to recover the money. I know the customer has the cash as it's a landlord with numerous properties and an income of over 200K, funny how they can't scrape a few hundred quid together eh?

  1. When this happened to me I sent a letter (rather victoriously) reminding him that he was now legally obliged to pay and pointing out the penalty for not doing so. The money duly arrived at the court within the 14 days.

I know I shouldnt say it but was the guy asian per chance?

  2. I'd wait 14 days to see if the other party pays the money into Court.

If that doiesn't happen then you can apply for an 'enforcement' order through the Courts, which basically means that they enforce the judgement and get you the money you were awarded
