Small claims court date question?

My husband is being sued in small claims court by a hospital for a bill that my husband & I neglected to pay. At this point they are refusing to set up a pymt arrangement and are requireing pymt in full which we can't do. They told me that I will have the option to set up an arrangement at the time of our court date. Is this really an "option"? We live in NC, what can we expect at the court date?

  1. They have no obligation to give you payments - either now, or in court.  Once it goes to court (and you're going to lose) you'll ALSO have to pay court costs.  The COURT might set up a payment plan, including interest of course, to pay off the total - guaranteed by a wage garnishment.

    Once you wait and ignore things, you kinda lose control over them.  I think you're going to be at the mercy of the court now.


  2. In court, the insurance company will not be the ones in charge, the judge will be. The judge will be telling you what options you have, not the insurance company.

  3. yes you can set up payment options through the court, just let them know you need an arrangement made and they will work with you.
