So...I'm going to court for disobeying a police officer!?

I'm so upset about this MISUSE OF POWER! To make a long story short...I was in the centre lane exiting a highway (centre lane goes right or left)....I saw construction signs as well as a police officer guiding traffic but due to cube vans and trucks I did not see that you could not make a right....until I heard an officer pounding my car with his fist! He yells "wrong way...back up and go left!" Now...backing up means backing into oncoming traffic. So I said "I can't do that. I can't see behind me."

So, instead of this officer guiding me or offering me help, he made me go into the right lane (where I wanted to go in the first place)....then he demanded that I pull over. He looked over at the construction workers and smiled (like haha!! woman in an suv....I'm going to show her...)....the laughing between the cop and construction workers continues as he was writing up my ticket....I couldn't believe that he didn't believe that I HONESTLY COULD NOT SEE HIM BECAUSE THERE WAS A HUGE TRUCK

  1. Sorry you had a bad experience.  Go to Court and explain to the judge what happened.


  2. I think this all depends on the judge you get. I would PRAY for a woman judge if I were you. The fact that he was laughing with the construction workers signifies that he was not approaching his duties in a serious manner.

    I would explain that you did not deliberately disobey the officer and you have no intention of doing so. Bring up your clean criminal record as well (if you have one). ALSO, include that the officer gave you instructions that could endanger others as well. He asked you to back up into oncoming traffic?

Fight it in court and tell the judge exactly what happened and make sure you tell how the Officer was pounding on your car, his demeanor and I would also recommend filing a police complaint for un-professional conduct, really, you should do that at the least. The guy was a jerk but try and take it with a grain of salt, there are a lot of good guys on the police force too, just that the job does attract some people that go a little overboard with power and get into the job just to have that power. So, go to court and file the complaint and things will work out for you I am betting.

  5. If it were I, (never had a ticket, my daughter did, I went with her to the Magistrate, she was put on 6 months probation) no ticket. BUT, If I were you, I would put my faith, in a fair Judge,

    telling the entire situation, like you did above.........I can picture the situation....big officer showing off to cons. workers.

    etc.  honestly prevails...............let the cards fall where they will, you will have a clear conscience, the officer knows what he did, even if it does not come thur to his brain for some time.  Who knows, you may even get a female Judge......who realizes what really went on..........

  6. In a charge like this, most of the time it is based on intent.  You obviously did not intend to disobey the officer's order.  Construction zones can be very confusing.  Go to court and explain your case.  Best of luck to you!

  7. I had a similar instancee. I was driving down the raod with everyone else and there is a motorcycle cop standing next to his bike puttin his ticket pad away and as I drove past ..and accidently having eye contact...as I drove on I looked in my mirror he jumped on his bike and I pulled o ver as his l;ite went on..cause I KNEW he was comin for me and he did. I was supposedly going 61 in a 55 and he could tell that by me driving by him with NO radar gun in site!!

    I went in front of a judge and he basically stated from his fat a-s chair that the cops would win..cause I had no proof he didn't have his gun out and aimed at me.

    So traffic school I went!

You can pay the ticket and try to forget about it or you can go to court and hope that he doesn't show (which sometimes they don't).  If he doesn't show it gets thrown out.  If he does show, it's your word against his, and who do you think a judge is going to believe.  You should make a dent on your car where he hit it and claim that he put a dent in your car... or maybe not.  You might still have to pay the ticket.  I don't know what to tell you, usually when someone gets violated by the law there is nothing they can do... it's a shame but that's the way it is.
