  1. 1. You can not buy an automatic weapon from a private citizen.

    2. You can not apply for the Form 4 Transfer unless you are working with a Class III Dealer.

    Felony, 10 years and $10,000 fine

    It can't be any simpler than that.


  2. There is no way around the tax stamp legally

    If I understand it correctly any transfer must go through a class 3 dealer

    Class 3 licenses are for selling automatic not for owning them

    You need no license to own an automatic weapon, just the tax stamp

  4. You can buy a registered NFA firearm from a private party in your state of residence only.  Yes, you do have to register it in your name and get the tax stamp.  

    Ignore those who claim that you need a license to own a registered NFA firearm, they are ignorant of the law.

    "3.2.6.1 Transfers by persons other than FFLs/SOTs to other such persons. Transferors of registered firearms must file ATF Forms 4, Application for Tax Paid Transfer and Registration of a Firearm, to register the firearm to the transferee and pay the applicable transfer tax.38 Appendix C contains a copy of the form. The form must be approved by ATF before the transfer may be made.39 ATF will not approve the form if the transfer, receipt, or possession of the firearm would place the transferee in violation of any Federal, State, or local law.40 A law enforcement certification is also required on ATF Form 4."

  6. Automatic guns are different than semi-auto's.   It's against the law for anyone other than a person holding a class 3 license to own an automatic weapon.  Where I live you must have a class 3 lecense to sell, and own one.

  7. Can you even do that?  I think you must go through a dealer.
