SO HOW do i become legal in the US? what kind of visa can i apply for?

This is why the immigration office is in business since they have all the answers you need. Most people in this section have no clue how any of that works.

You could apply for a K-1 visa which is for a spouse or you could apply for Immigrant Visa. Those are your only two choices. If you weren't already in the USA you would be able to apply for a K-3 visa which is Fiance and its a bit easier to get than the other two and the process is a lot shorter. Good luck.
