Question:

So my sandal got caught in the esclator at the store, they keep calling? Are they afraid of a lawsuit?

I wouldn't sue because I was not hurt. But I think they want to make a settlement or something so they wont get a bad rep.

So If they settle? Would I get money just so they would make sure I wont sue or anything?

Help me understand this please.

If you had been in an auto accident, the insurance company who would have to pay for the incident would want a statement from you so they could try to trip you up later and say you said something different before.  They try to twist things in their favor and leave the injured person without a settlement that was rightfully theirs.

    If they keep calling, they want to know if the injury could cause you to sue them. If they offer a "settelement" without involving fair representation for you, then you will be asked to sign something that says you can never sue them for that incident.

    If you were caught in the escalator, was some part of your body stuck in it?  I would personally call an attorney to get advice. They may be trying to cover up a faulty escalator or possibly even some other incident with serious injuries to someone else and don't want this to become a class action lawsuit or some such thing..

    An attorney would be able to dig into the court records easier to see if others have had injuries too.  They seem too eager to get you to sign off any rights you could have.

    Maybe you should contact an attorney for advice.


  2. escalator accidents are very serious.

    there probably is, or ought to be a sign that says no sandals or open shoes.

    it is a good way to lose your foot or leg.

    yes, they are taking it seriously, and no, they will not stop calling until you take it seriously too.

    i am sure you can find an attorney in the yellow pages who will represent you on terms you can live with, and then you can direct future calls to him or her.

  3. They are probably trying to find out if you are hurt.

    They may want you to tell more than one of their represenatives that you are not hurt to protect them in court.

    A lot of people just sue no matter what and try to get money out of stores.

    If they offer you money, there will be a release that you sign that will absolve them of any additional damages.

    I was reading a story about people doing this in the area that I live ( falling in stores to get money ).

    The said a fall was worth about $4,500.00
