Question:

Social Security Benefits?

My son's father passed away back in November and recently found out he fathered another child just last week. How hard will it be for this other mother to obtain social security benefits for her child if they weren't married and will this effect my son's benefits? I am slightly worried I will have to pay some of it back?

  1. I can't see that you have anything to worry about

  2. The other mother will have to first prove paternity (that your son and hers do in fact share the same father).  With proof she can request funds from social security.  Your son's benifits may be cut in half.  I'm not sure if they will make you repay benifits recieved before paternity is proven.  It seems unlikely.  You shouldn't be punished for other mothers failure to act.  Hope this helps.  Good luck!  =-)
