Question:

Someone bought husband's truck and then wrecked it? Help!?

My husband just sold his truck. He left the plates on for the guy until the guy could get it plated in a few days. (yeah, that might have not been the best move). Trouble is, the guy wrecked the truck in the hailstorm we had today. He ran into the back of a SUV! He called us tonight to tell us about it. Of course, he had not registered the truck in his name yet. I had the truck taken off of our insurance the day we sold it. The new owner HAS NO INSURANCE on the truck. It is just a big mess. What could come of this???

P.S. I actually feel kind of bad for the guy... he is older and has a pace-maker and really is a nice fellow.

  1. you shouldn't be liable as long as you finalised the sale before he totaled the truck...but the licence plates could come back at you! just have a barrister on hand incase


  2. Go get your plates off the truck and make sure you have a copy of the bill of sale.

  3. You should have filled out a release of liability when you sold it showing the date of sale, other wise you may be liable. You should contact the buyer and ask him if he has insurance of any kind, if so then his insurance will cover it most likely but don't count on it. An attorney might be the next best thing to do.   5. Do you have a copy of the bill of sale, showing the date of the sale? Or a check from the guy with the date on it? You may need some sort of proof  down the line. Good luck!

  6. Have you been paid in full for the vehicle?  Did you keep a copy of the bill of sale?  If the answer to both is yes, you are on the hook for no more than sympathy to the poor fellow.   He has to know that, but obviously was hoping you hadn't cancelled coverage yet.
