  1. As a law enforcement officer that has spent a lot of time in court on cases, all I can say is:

It is up to the judge. There is no way of telling (not even with an arranged plea bargain with the prosecutor) of what the sentence will be.

A judge may take into account what the person is doing with their life, their past criminal activities, and demeanor during proceedings.

Just remember, the judge DOES NOT have to accept ANY plea agreement made between the defendant (your boyfriend) and the prosecutor.

  2. Every state classifies crimes differently and every state has their own sentencing scheme, and every judge has his own notions of how to sentence people within the allowable range.  Knowing nothing but the level of crime, not even what state you are in, no one here can give you meaningful info.

  3. It doesn't matter their background.  It matters the crime they committed.

Whether or not they have a criminal background can decide what kind of sentence they are given once convicted of the crime.  It can also be a factor on whether or not the prosecutor plea bargains the crime down or makes a deal with the defendant.

sounds like a bad situation.  Good luck to you.
