Question:

Someone rear ended my car and i dont have insurance and she does. is there something i can do? the car is bad.

MY KIDS WERE IN THE CAR AND I HURT MY NECK PRETTY BAD. MY CAR IS DAMAGED, BUT, AS I SAID, THERE IS NO INSURANCE. HELP!! THANKS.

  1. if your in fl. were a no fault state there is nothing you can do for not having insurance but she can sue you for being on the road without any


  2. You have to have car insurance to operate the vehicle. Unless your not in the US. But I am not sure. Who's fault was it? Did you brake really fast or were you stopped and she didn't? It all depends what happened. But most likely you can't do anything. I would suggest talking to your lawyer/attorney they will always try to help (They do get paid for it)

  3. first question is were you suppose to have it then its your fault for being on the road.. if not its still her fault  for hitting you her insureance will or shoul dtake car of any doctor bills maybe but has for your car your out of luck

  4. if she rear ended you its her fault, her insurance will pay for your car if not go after them. its the law, at least in MA. thats the point of insurance so she don't have to pay for your car her insurance will

  5. I had quite a few ppl hit my car while I didn't have insurance, thank god it wasn't THAT bad though.. I couldn't do anything b/c I didn't have insurance.. at least to my knowledge. You should probably call a lawyer though just to ask these kind of questions.. you don't have to give them your info or anything but I would just get some advice from them, or if they try to charge you for advice call up legal aid, they'll help you out! - sorry, best of luck tho!!

  6. It may be the case that her insurance may have to pay for her causing the accident, but investigations into the accident will question your own insurance. If you mean you were not insured to drive this vehicle, that's a criminal offence, plus if you have no insurance , I assume you have no road tax (another criminal offence).

  7. If it's illegal for you to not have insurance in your state then you'd automatically be at fault since you aren't supposed to be on the road.

  8. Technically you shouldnt be driving without insurance. But since you were, find out if the police declared it her fault or not. If so, you can file a claim with her insurance company, and everything is ok. If its no fault, or your fault, then its coming out of your pocket to fix. If her insurance company comes after you (if its your fault), then you could be sued for all you have by them. The key is finding out whose fault it was from the police.

  9. If they were at fault, they will have to pay.  The fact that you do not have insurance has nothing to do with it.   Please do not drive without insurance, especially if you have kids in the car....!

    It is obvious that you have a computer and all of it's related expenses, sell your computer and buy insurance.

  11. Actually, no their isn't anything you can do. Even if it was her fault. Courts across america have chosen to agree on similar cases for people dirving with no insurance. They believe the accident wouldnt have occured if you weren't driving b/c its illegal to drive without insurance.

    On the other hand, You may need to be close to an attorney b/c even if her insurance pays for her vehicle, she can and will sue you for having no insurance. If she has your information her insurance company will file a law suit against you and sue you for all her repairs that they had to pay for her car. They will win, it happens every day.

  12. It does not matter that you were uninsured in terms of the other party's legal liability.   Call the other insurance company and file a claim.  

    I would not get too greedy over your potential injury claim.   Ask for your meds to be paid and be grateful.  

    FYI - you may live in a No Pay, No Play state.  If this is the case you may not be entitled to any non-economic damages.

As long as the accident is her fault you can contact her insurance company and explain the situation to them and let them know that she was the at fault driver and they will either tell you to go get estimates or they will send out there own investigator to look at your car. As far as your injuries you will have to talk to her insurance company if they refuse to do anything you can take them to civil court for the amount of your hospital bills under pain and suffering. but in some states there is a statued of limitations on how long you have to go to the doctor and get your neck looked at so you might not wanna wait too long

  14. If she rear-ended you, then the accident is her fault and her insurance company will have to pay for everything.  Hopefully you filed a police report; that will help.  If you have her insurance info., give them a call and tell them what happened.

  15. It was her fault, not yours. File a claim against her insurance. They will pay to repair your car and your medical damages. GET INSURANCE!!!!!!! It's illegal to not have it and you can have your license suspended.
