  1. not tru you should have been a safe distance from the other car. so it will go something like this the car that hit you will be like 70% at fault and you wil be 30% at fault your rates are going up hold on for the ride.

As silly as this is... the car behind you will be responsible for hitting you, but you would be responsible for rear ending the other car in front of you.  BUT your insurance company will probably try to subrogate against the car who hit you.  Meaning you may have to pay your deductible but might be able to get it back.  The worst case scenario is you could go after the person who hit you and sue them for liability damages.

    Please keep in mind insurance varies from state to state so I am talking about PA.

  3. well it should be the person who hit you,But I bet that you will get failure to control,even though you could not help from hitting the other car.

If he rear ended you caused you to be pushed into the vehicle in front of you then no it is not your fault.  If you rear ended the vehicle first and then got rear ended and pushed into that vehicle again then both of you are at fault.  If you were not rear ended, you would not have hit the vehicle in front of you, therefore it is not your fault.  Now, if the other driver says you hit the guy first before he hit you.  Or the first guy in line says he felt two distinct hits, you may have a problem proving the other guy pushed you into him.

  6. If you and the care in front of you were both stopped, the car that hit you would be at fault.

  7. the guy rearended you is at fault.  trust me.
