Question:

Someone sold me a car that broke down the day after I got it home. Could i win in small claims court?

I bought a car from someone, everything looked good. We went back and forth for a few weeks and I tested it out. He even let me keep it for a week before I payed for it all. But as soon as the money was transfered and the title given to me, and he let me drive the car home for good, the car wouldn't start the next day. I don't have any proof that he did anything wrong (no contract or anything, just a friend of the family so it was a simple deal) so I was wondering if I could take him to small claims court or would it be a waste of time.

  2. You can try, but you won't win. Used cars are sold "as is". It is your responsibility as the buyer to determine the condition of the vehicle before buying it. It's a used car, you didn't say what the nature of the problem was, but you have to expect some issues when buying used. Learn from this.

  3. Depends on if he sold you the car as a "as is". More than likely is a waste of your time & money. Find out what is wrong with it, could be as simple as a dead battery.
