Question:

Someone walked in front of my car and I almost hit him...?

I was pulling into the parking lot of my work and someone walked in front of my car and I almost hit him. He wasn't directly in front of my car but very close so maybe he was already in the crosswalk and I just didn't see him? At any rate, I know I didn't hit him, just came close. I pressed my brakes and he started yelling at me. I drove away to go park and he ran up to my car and started kicking my door and window and tried the handle to get in. I drove away and called security to escort me since I didn't if this guy was going to hurt me if I got out. They're checking surveillance and I filed a report...Do any of you think I have anything to worry about legally? There was a very bright glare on my windshield so I barely even saw him while he was yelling at me....It could be possible that I brushed him, but I didn't hear or feel anything and he was well enough to try to kick my window in....

  1. If you didn't hit him, you have nothing to worry about.  NO laws against close calls.  

    That guy should thank his lucky stars, though, because kicking your car is against the law if he damaged it at all...and he could have been cited.


  2. Well he's crazy and angry, but it's all good because nothing happened. You didn't hit him and no legal action will be taken.

  3. I wouldnt worry about the law I would be worried about where to get you a tazer gun or some mace and maybe a little knife. just a thought

  4. well sounds like you should have hit him..and run over him again..i think what he did was uncalled for...why was he in the way anyways!?..he didnt look i am guessing..and you weren't speeding right..?

  6. the law requires you to give way to peds.  ped rage is not unusual, but needs to be eliminated.  If you injured him, you will have problems with your CTP insurance, but if he hasn't had a medical report done, then his claim falls down a bit.  be more observant, and constipate(sic) on what you're doing.  You couldn't have felt anything, even if you crushed him to death.  BTW you prob did hit him, hence the outrage.  Glare is a mitigating factor, but not a release from reponsibility.  Since I presume you drive there every day abt the same time, you should know abt it, and drive accordingly.

  7. You should have run him over the second time in self defense.  You have nothing to worry about obviously since you didn't actually hit him.

In some states even if you hit him sometimes you won't be liable.  Like in Florida (at least a few years ago) if a pedestrian crosses the street in an unmarked crossing that is not within an intersection he has no right of way.  Totally the opposite in states like California where a pedestrian can jump on your car from anywhere and it would be the driver's fault. However, in your case the pedestrian was in a cross walk so hopefully you didn't hit him.  You can't get a ticket either because there was no police officer to witness it.

    He probably was so scared that he turned it into anger and wigged out. You did the right thing in all cases to ensure your safety because even if you did hit him you don't have to expose yourself to any harm from a wigged-out victim.
