Something freaky about my DR?

I am very bored so I typed in my Dr's name and something came up about him being sued for malpractice on July 2005. Here is what it says;

Shana Smith sued Dr. Daniel Villarosa on a medical malpractice theory claiming that he was negligent in the handling of her pregnancy with the result that her baby was stillborn. She claimed that Dr. Villarosa was negligent in his diagnosis or treatment of the plaintiff and that his negligence was a substantial factor in causing the outcome of the plaintiff's pregnancy. She claimed that Villarosa failed to respond in a timely manner to deliver her baby.

The defendant claimed that he did nothing wrong in his care and treatment of Ms. Smith and that the fate of her baby was sealed before the birth as evidenced by significant damage to the heart and brain of the baby that occurred during pregnancy.I am 28 weeks pregnant do you think I should change doctor??

  1. Chances are he has delivered lots of babies and this was one case out of a lot of healthy babies.  I still personally would change.  To me, that's just scary as h**l.  Chances are nothing would happen to your baby and everything will go just fine if you continue with him, but why take that chance?  I'm sure if that woman could tell you to, she would say to switch doctors!


  2. its very rare for drs these days to make it through a medical career without having someone try and sue especially obgyns.. Dealing with a stillborn is very hard and ppl react in a way that will help them deal with their greif.

    if you are happy with your dr so far then there is no reason to panic. I am sure he is very cautious these days after having such a horrific ordeal on his hands. A Dr is his position would have lost countless nights sleep  along with the parents. What  happened was not something any Dr would take lightly. He has gone through a lot with this court case obviously and would be dotting his i's and crossing his t's and monitoring every baby and mother extra carefully that he doesnt have to deliver a stillborn ever again.

    Like someone said earlier there could be many other factors that could of ended that pregnancy... its completely up to you but what happened back then has only made him a more diliegent, alert dr.

No, sometimes when someone experiences a loss like this woman, they need someone to blame.  The doctor isn't responsible for the baby having heart and brain damage.  If you check into it, almost every doctor has had some kind of suit brought against them in the past.  There is only so much a doctor can do for a woman/baby during pregnancy.  Also, the nurses at the labor and delivery department are trained and experienced in handling a situation where a pregnant woman progresses so fast the doctor can't get there in time for delivery.

    With that said, if you are feeling very uncomfortable about your doctor now, then change.  You need to be able to feel at ease, comfortable, and reassured by the doctor you see during pregnancy/delivery.  You don't need to go into delivery with any added stress.

    This woman may have had a stillborn baby regardless of WHO her Dr was. If you have been otherwise happy with the treatment that you have received from your Dr why would this make a difference.

    Unfortunately in this day and age people are so desperate for someone to blame when things go wrong that they will sue people just for the sake of it.

    you have to do what you think is best for yourself and your child.

  8. no. it is obviously a complaint that would be verified.does it say he was fined or had some type of discipline. it sounds to me like the grieving mother had to have someone to blame.imagine having the news that the baby you have loved and felt growing inside you,that you shopped for and waited for and named  was born dead. it is a horrible tragedy however it is not uncommon for the mother to try to blame the doctor,often also blaming themselves.if you are comfortable asking the doctor telling him you saw this on the internet and wondered what happened,  go ahead. if he does not respond to your liking get rid of him. he will not be able to tell you specifics about the case because it would be a HIPAA violation for which he could get into big trouble. the lawsuit is public knowledge. you can tell the doctor your concerns and see what he has to say. or if you are very uncomfortable find another physician however, the same way you found this out you can find out how long he has been in practice and how many successful deliveries he has had. its up to you truthfully though, it dosent sound like it was the doctors fault because no judgement was paid and no discipline has been given. just sounds like a tragedy.he is probably innocent and if you have been comfortable with and liked him till now, then stay with him but talk to him about it.tell him if you need to that a friend looked him up on the internet and showed you and you were wondering what happened. you deserve to have a doctor that you are comfortable with. do not-not confront him and feel worrried your whole pregnancy.get it out talk to him and then decide.

  9. If this is all true about your doctor, I'd definitely be seeing a different one. You're going to be stressed out enough when giving birth, so you don't need a bad doctor causing problems.

    When my mother had me, her doctor just stood against a wall and didn't know what to do. I'm very lucky to be here. I wouldn't risk it, if I were you.
