  1. Attention problems cannot legally be diagnosed by a school district.  If the school even suggests that a child has ADD/ADHD, the parent has legal recourse.  Attention deficiencies are medical diagnoses that have to be made by a licensed physician.  This is probably why your cousin is not getting help in school.  His parents have to take him to his doctor and tell that person they want to know if their child had ADD/ADHD.  These diagnoses are NOT the same as a learning disability, although learning disabilities can occur at the same time.

You haven't said how old you are, but ADD/ADHD was not diagnosed as often as it is now.  It wasn't officially recognized as a disability.  You may have been one of those kids who had it and was never caught because it wasn't an accepted disability at the time.  You say your mom thought nothing of it. Did she take you to the doctor and specifically ask about ADD/ADHD?

  2. The parent to the child needs to request in writing that testing needs to be done. The request needs to go to the special education dept.Once the parent makes the request, the school district has 45 school days to do testing and hold a meeting to go over results. When requesting testing, do not give insurance information if requested.Because if you give it, school will bill insurance co. instead of school paying for it.If insurance co. billed, the parent will be unable to get additional testing done if not satisfied with schools results.

  3. This is typical of schools. THe school just says there are no learning problems and pass you on thru and say you are lazy because they don't want to spend the money and they don't want to help.

They ruin the child and CAUSE low self esteem in kids because they don't want to help them.

Even though they get money for each sped student, seems like to me they WOULD want sped kids so they can get that  money.

Anyway, special ed is mandated by federal law called 'IDEA' and it states that the parents and schools must follow a specific legal process in getting children help thru special ed.

And schools will NOT let you know what this process is, even though by law they are suppose to.

The reason they do all this c**p is because there is no enforcment to make them follow the laws and they know it.

You can't help 'these people' , they know what they are doing wrong.

The first step that needs to happen is for the parents to write a letter to the district sped director requesting

'an initial full educational evaluation testing in all areas of suspected disabilites to determine if my child can qualify for special ed services as specified by IDEA law.'

You HAVE To use these words so that if they DON"T do this eval, you can file formal state complaint.

  4. you could help your cousin by taking him to a Developmental Clinic where they test children for learning disabilities and let them run some tests and let them give you the results.  I have been going through some of the same problems that you are talking about with you and your cousin with my own children.  My youngest son was finally diagnosed with Bi-polar and schizo and he is now enrolled in a special school that is specifically designed for Special Needs Children, and he is doing much better.  The public school system does not want to measure up when you have a child that is a behavioral problem, that is how they look at the child, they do not look at the child as a child with difficulties.  They need to understand that there is something going on and that this child needs help.

You can be an advocate for this young child,a nd try and get him the help that he needs.  Contact the following agencies if you have them in your hometown:  The Mental Health Center

The Disabilities and Special Needs Board,  The Special Services Department  of the Local School district.  Also seek professional doctors and hopefully this will give you the edge that you need.  Best of Luck to you.  If I can offer you any other help or with any other information that you need, let me know, you may e-mail me at spartan2bound@yahoo.com
