I have recieved 2 notices from the police of an speed alleged offences (driving in a 30mph at 40mph speed), someone else a friend of my father was driving the vehicle. both are the same location but at different dares and same speed limit.

However, We gave the details of the person whom was driving and basically she isnt coming forward, she has moved somewhere and we dont know.

That is putting us to face the music and deal with her mess, however because she was driving my car,

I just wanted to know where I stand legally if the police and I dont find her,

  1. can you prove you were not the driver at the time , ie were you out of the area , can you provide witnesses to back you up at the time the offence . certainly you need to request the photographic proof . ideally at the time of the offence were you somewhere where there is cctv or other means of backing up your story .  IF you can prove you were not the driver then i wouldnt be too woried but contact a proffesional to get advice , good luck .

  2. Try this site, you will need to join and then ask the experts what to do.http://www.pepipoo.com/

  3. First off, PROVIDED the dead line hasn't passed for returning the documents, you don't have to sign anything. Don't let the deadline pass on the ticket though as this will make things worse!!. Contact the police and ask to see the photographic evidence - you have the right to see this - make sure the picture is not blurred!, you also have a right to request the calibration certificate for the speed camera to prove it was functioning properly. Give this guy a call: Nick Freeman - 0870 460 7007 - he is a lawyer that specialises in this type of thing.

  4. Legally you will be held liable, it's the owner of the cars responsibility.!!!

Good luck thou as the same happened to me and I had to pay for my friend.!!!

  5. The police will not believe you and you havn't got a leg to stand on  .Learn from your mistake and don't lend your car to 'friends'.

  6. you need some legal advice
