Question:

Speeding Ticket in Hawaii?

I got a speeding ticket in honolulu for going 70 in a 55 on a major interstate. I know I was not going over 65- I had the cruise control set. In addition, there were cars around me going the same speed. The cop claimed to have clocked me with a laser. What can I do to defend my ticket? Also, what can I do to avoid raising my insurance rates for a bullshit ticket?

  1. Talk with the public prosecutor to see about getting the ticket knocked down to something without points on you license.  You can question the officer's training certification with the laser, you can question the last time the laser was calibrated, you can question if the officer was moving or stationary and if the laser was set up properly.  Being from NJ, I'm not sure if HI has similar laws, but see if you can get the ticket changed to "not obeying traffic signs", which means not obeying the speed limit signs.  This is a no point ticket here in NJ.

  2. Go to your court date as printed on the ticket.  Plead NOT GUILTY.  The you will be assigned a plea/arraignment second court date.  Go to that court date.  The DA will have a prosecutor there who will offer you a plea bargain deal and probably knock it down to a parking violation and reduced fine.
