Speeding Ticket in VA(FirstTime)

I got a Speeding ticket 52/35. This is my first ticket. I was struck in traffic for 20 mins on I-95, I took an exit for alternate local route. Is there a way can I defend my case?. BTW I was driving with my wife, she was 8 months pregnant, she started getting cramps, which made me to drive at 52mph which was unintenional.

  1. You were speeding, plain and simple. I would just pay the ticket. Those speed limits are there for a reason. If your wife was pregnant, I would be even more cautious with the speed limit, and if there were a medical emergency, call 911.  


  2. Not unless you lie - you were going over the speed limit.  

    Unless you can prove that you weren't really going that fast, there's no ethical way to avoid the ticket.

    Don't do the crime if you can't do the time.


  3. Pay it- if shes in labor then you should have called an ambulance.

    However, if you do fight it, they'll normally cut the fine in half but you'll still have points on your record.

  4. hey bud, seriously talk to a lawyer, it's expensive but may be worth it. a plea out to a non-moving violation by a lawyer will be less expensive than the insurance hike after you get the insurance points.

    the answers after me aren't exactly accurate, though the people mean well. but everyone has got caught speeding at some point, so i'm surprised they're being so judgmental. if you retain a lawyer, the commonwealth's attorney is not going to go to trial over a speeding ticket if speeding is the only offense; they will plea the charge out w/ the lawyer so they can move on with their bigger case load. so most lawyers will plea you to a non-moving violation like improper equipment and no you won't get points. take it from someone who now has 4 improper equipment charges on his record, and no insurance points
