I have had a summons for speeding and have noted that the police officer in his written and signed statement has said that he noted that I have 11 points on my licence. I don't have 11 points nor could he have seen my paper licence as it was stolen in a house burglary a couple of months before and I have not yet replaced it. The above can be proved but what can I do I cannot afford a solicitor. Any help would be appreciated preferably from anyone who knows about the relevant laws.

  1. Citizens advice is a great start,they have solicitors etc.

    the police can actually see a copy of your licence now via their computer screen,and all the info on you will be on it.

    did you inform dvla the day your licence was lost?if not you will be liable for any penalties on it to date.

    It is your responsibility to inform them in writing that your licence was lost stolen,but if you had by now you would have received a new licence with your picture on.

    You have to call dvla or email them right away .

  2. he could get your drivers information if he ran your social or name and date of birth.  if you dont have 11 points on your license then prove it in court.

  3. You will be dealt with on the basis of the offence for which you have just been charged.

    If found guilty then you will be required to send your licence to the DVLA to have the relevant points added. At that point the officers mistake will become obvious.

    The mistake will have no bearing on your innocence or guilt of the present issue

  4. Is it possible that the person who stole your licence as also stollen your identity and put more endorsements on your licence?  If you reported your licence stollen at the time it should be OK because they will know any other endorsement added after that time are not yours.

  5. assume you are in UK so see the Citizens advice bureau without delay their legal dept, if they can't help, they should be able to advise what your next step would be.

  6. We have access to the DVLA data base, so a quick check on the radio tells us everything. We don't need to look at your licence.

    What you have neglected to say is whether you were in fact speeding or not.

    I do enjoy people going to court and trying to get off on these technicalities, they end up making themselves looking silly.

    If you were speeding id admit it, if not then defend it in court.

    I always ask for costs when people go to court, and this will amount to about £400 for a half day trial, that is on top of the speeding fine, points and of course the £15 victim surcharge.

  7. It takes around 4 days for a police officer to get a full copy printout out of all your licence details from the DVLA at Swansea. They are allowed by law to request this information and the copy is certified so can be used in court proceedings.

    Suggest you get your part 2 licence replaced from Swansea asap as the court will require it.

    Regret the details surroundng your licence will have no bearing on the speeding offence as regards being found guilty or not guilty of speeding.

    Clearly though you need to to show your part 2 to the court or you will receive an automatic driving ban for going to 12 points (assuming you are correct and in fact have less than 9 points on your licence)
