Do you know cases where a legitimate spousal visa was denied by the Immigration dept.?

Yes, of course.  A spouse doesn't get a visa just because the marriage is legitimate.  The foreign spouse must meet the criteria for a visa and there are many.  For instance, prior conviction of a crime of moral turpitude will cause the visa to be rejected.  A past history of illegal drug use will result in a rejection.  A past history of illegally entering the United States, or falsely claiming to be a US citizen, are grounds for rejection.

    Like I said, there are many things that can trip a person up.  You must understand, there is no "RIGHT" to a visa.... not even for the spouse of a US citizen.

Fortunately it didn't happen in my case, but it definitely does.  If the petitioner can't prove that he/she has the sufficient financial resources to take care of the spouse once they're in the country, the visa will be rejected.  They really scrutinize finances, so that's the difficult part.  Denial can also come if the couple cannot prove they have a genuine, established relationship.  This means the spouse seeking the visa needs to come prepared with pictures with the petitioner, email correspondences between the couple, etc.  That's pretty easy to do, but you'd be surprised how often the relationship is just a scam to get a green card.  When all else fails, contact an immigration lawyer.
