Still have not received my child support income tax withheld return?

My ex filed for his taxes before March 15th and of courses he is behind $10,000. They took his return and stimulus from him. I've been waiting on just the tax refund itself for 3 months now. Can anyone tell me why it takes this long (TEXAS)? And when I should be expecting it?

  1. IF YOUR EX IS MARRIED AND FILED A JOINT RETURN WITH SPOUSE then it'll be held for up to 6 months to allow the spouse to file an injured spouse claim form 8379 to recover her half of the refund/rebate so that it will not go to you,that's the time limit they give her to file.

    if he's not married then you should have received it within 30-45 days afterwards,unless u were/is on public assistance or you/he owes other debts such as student loans/back taxes then it'll be taken to pay that off of course.

First of all, I'm a little confused.  If he is your "ex", why are YOU expecting a refund?  Do you mean he has not sent you the child support payments.  If you are divorced then he had to file his own return as a single filer (unless as the previous poster suggested - he has remarried - in which case they are probably filing a joint return - however you don't say that he is re-married).  In any event, if you have file a complaint that he has not paid child support, and he is behind $10,000 in government debt or child support payments, they will take whatever refund he has coming to him plus the stimulus.  

    I would suggest you call the IRS/your lawyer or whoever you have been working with to ask this question.
