Strange leagal question?

if a man with a mental disability gets into a fist fight with a senior citizen, would the disabled person go to jail???

Where the heck do you live?  Move out or throw him out.  If he started it then you should have filed charges of assault against him.  In regards to the old man, the judge would probably look down on you for fighting with him.  Your disability won't affect your case at all.  If you were mentally retarded, it would.  If you got charged, the judge would order anger management, therapy, more sessions with the shrink, etc.  If you are doing well on your meds, move foreward and find a different place to live and a different environment.  Your mental disability isn't an excuse for your behavior.

If there is enough physical evidence, then both of you would go to jail.  This is referred to as 'mutual combat'.  If an officer can not figure out who the aggressor is, then both parties should be arrested.

it depends.  no offense intended whatsoever, but do you really expect to get a solid answer after providing such limited information?  specifically, what is the disability, where does he live (which State) and what happened (was the person injured?  who started it?  are the police involved?...)

You'll both go to jail. So call the cops if you both want to go to jail, I guess. Otherwise, keep the police out of it.
