Student visa has expired? Help?

Question

A lady who works with me has told me that her visa has expired. I think she was on a student visa. I asked her what she has done about it and she said she has applied for a renewal. She said the renewal application can take upto six weeks.

What I want to ask is whether she is officialy an illegal immigrant or whether she allowed to remain in the country whilst her visa renewal application is ongoing.

if she told you that her visa is expired, she is illegal. but if she submit the application before her visa rans out, she's not illegal...

so long as she has applied for renewal within the specified times she is ok. If she has not even applied then it will be very difficult and she will probably have to leave (better that than be deported) and may have restrictions on her being able to return.

However, how is she working if her spouse is on a student visa? He is not allowed to work and must support any dependants without recourse to public funds.

You can sponsor her Visa yourself, but as of now she is illegal and could be arrested and deported. She needs to apply for an extension now. It is a long process.

If you hire her or her husband, and know that the Visa has expired, then you have illegal aliens working for you and could be subject to fines of $10,000 or more on each count.

She's only been illegally here for 2 days, give the woman a break. People come over here and there visas expired years ago. What real business is it of yours anyway? she told you no doubt thinking you were a friend, great friend you are then telling everyone. The authorities will catch up with her if they feel it necessary go back and get on with your life and let her deal with hers.

if this is related to the UK she would be an illegal immigrant, which is why student visa are applied for outside of the eurozone.
