Sub letting as a lease-holder of a house in Perth?

just wondering if you are allowed to rent a house, put your name on the lease and then sub let the spare rooms to people. do they have to be on the lease if they are living there. what kind of trouble can you get into if you are not allowed to do that? and who enforces those rules?

  1. A tenant does have a right to sublet the premises BUT this needs to be with the owners permission.  They will also need to be listed as a person who may normally reside at the premises but this does not mean they are a lease holder.  First step is to contact the agent or the landlord and provide them with the details for the new flatmates.  If you go about it the right way then you'll impress the owner with your wish to go about things properly and this shows that you respect them and their property.

    If you don't do this you risk being found in breach of your tenancy agreement.  On the front page it will say how many people may ordinarily occupy the premises and if you exceed this amount without prior consent you CAN have your lease terminated.


  2. it really depends on your lease with the estate agent.

    usually as part of the contract between yourself and the real estate agent, there will be a clause stating that you are not allowed to sub-let unless you have their permission.  they basically want to know who is in the house.

    i'm assuming, that if you don't tell them, you are breaching the terms of your lease, and they may be well within your rights to evict you.
