Subletting to Coworker?

My coworker is moving into my place next weekend. I'm worried about subletting because if he defaults on his rent, aren't I responsible? How does this work??

I wanted to break the lease and him start a new one but I don't think my landlord is willing to do it, and really, I just need out.

What happens if he misses a rent payment?

  1. Subletting means that you are renting part of your leased premises to another person. To do that legally, your lease must contain a provision that permits you to do so. Usually, this means that the person you sublet to pays you directly, as you are responsible for the entire lease amount.

    That your sublettor is paying rent directly to your landlord is odd, because *you* are his landlord. However, it indicates the landlord's approval of the arrangement, even if a sublet provision does not exist in your lease. It also should give you some wiggling room if your sublettor fails to pay his rent.
