  2. Are you asking how to sue for a non-sufficient funds check? I live in Michigan, and the way to collect here is by first sending a letter or notice to the person requesting that they pay for the bad check within 5 days of the date of the letter. Then, if they do not pay, you can get a form from the police station to send in to collect restitution. I'm not sure if it's the same in other states. You may be able to call your local police department, or prosecuting attorney's office for more information.  

  3. Yes you can, but why not try to settle it first out of court. Ask the person for the amount of the check, plus the amount you were charged by the bank, plus any other reasonable fees that you may have incurred (such as time it took you to go to the bank and contact him about the bounced check). If he refuses, sue him for all this, plus legal fees.

  4. Yes, you sue the person that wrote you the check in small claims courts if it's under $10,000. You do not need an attorney to use small claims court

  5. Call your police department before you do anything with the court, it's illegal to write a bad check and some departments will still follow up on it - often a call from a police department will get a check paid quicker
