Question:

Sueing someone for 3400 dollars? Where does it come from?

Over the past 2 years, I have let my boyfriend borrow about 3500 dollars total. I have it all written down ( 2 copies signed by him and I), promising to pay me back within "a reasonable time frame" The only problem is that he does not work, lives in a 1 bed cheap nasty hotel with his brother, and is very lazy. So if i take him to small clamis court, where will I get this money from? Does it come from the state then he owes the state? Does it go into a collection? Or do I have to wait for him to start working and then they garnish his wages? Sueing him will make him not get a job even more. He only gets side jobs under the table from craigslist.com, Just enough to pay for the hotel, food, and cigarettes for the week. He is 23 and his brother is 28 and neither of them work! What is wrong with these people i work full time and am going to school full time to be a pharmacist! I cannot take it anymore but can someone please help me out?

  1. You choose, your choice!  

    Make a new plan with a new guy that is more in character with you and your goals.

    The only one responsible for paying you is your boyfriend. There is no need to take him to court, it'll be another piece of paper he signed, that is a waste of your time.  A wage garnishment is useless if he doesn't have a full time job.

    We learn from our mistakes and grow from them.  You just spent $3,400.00 on lesson #101 Bad Character and how bad character can affect you.  Now you need to graduate and move on with your life, far away from this guy.

  2. When you sue, you get (if victorious) a court judgment that affirms his debt to you.  You still have to actually collect the money from him.  There is no "pot of money" somewhere that pays you.

  3. ~~The judgement you get if you win just allows you the power to start legal means of collecting your money from him. You can have his wages garnished (sounds like a long wait), or if he ownes a car you may be able to go after that if it's in his name, any kind of valuable collaterol. The court will help explain the follow up to collect once you win your claim. I wish you the best of luck and hope you get to collect!~~One other good this is you can have the judgement enter on his financial reports which doesn't help you right now, but at least it'll hurt him somewhere down the line (no credit till that's paid), and then it causes his credit to look bad!

  4. That's pretty messed up!  But, yeah the money would still come from him, if he paid it.

  5. You will not get your money up front. Winning your case, will  have a judge give him a court order to pay you.  If he has no money, then hhis wages will be garnished.
