Question:

Suing public pool because unsecured pool floor vents- safety violation?

Well, while swimming we spotted the sealed floor vents [(releasing water) with writing from company on it.."Keep secured or may result in serious injury or death"..]. We found several of them unscrewed, loose, or releasing air. Is there, if so, any way to sue for safety violations?

  1. Tell the pool management.  They will s***w them down.  You do not have a case to sue them unless you were actually injured.  The company that makes the vents does not set safety codes.


  2. Why not just tell them they are unscrewed?  They didn't hurt you or anyone, so tell them and they will probably get someone on it.

    Why jump to suing...give people a chance.

  3. You cannot pursue legal action unless you have suffered injury. This means that you have either a tort or a loss. The printing on the sign is the manufacturers way of getting off the hook for being liable if they are not fastened down.
