Well, in the US, that would be called tampering.  It depends on whether the law enforment authorities knew that the employee was going to perform that act - if so, then any evidence gathered would be thrown out on a technicality called "fruit from a poisoned tree".  If they didn't know. then any evidence gathered would be legal.  Additionally, your defence should be able to come up with a couple of points, such as the fact that anything in the package could have been placed there by someone while the package was opened.

    Unless the company has a stated policy that any package mailed can be opened, you can sue them.

    In any case, talk to an attorney.
