THE HOA IN MY COMMUNITY IS SAYING THAT WE HAVE TO PAY THE DUES OF THOSE NOT PAYING, IS THAT TRUE? ?

IN 45 DAYS WE WILL NOT HAVE PHONE, CABLE, AND INTERNET SERVICES BECAUSE THE ACCOUNTS ARE PAST DUE. THE HOA IS GOING TO BE TURNED OVER TO THE HOMEOWNERS IN 2 MONTHS, IS THERE A WAY TO MAKE THE HOA GO AFTER THE OWNERS OF THE RENTALS TO COLLECT THEIR DUES? WHAT TYPE OF LAWYER WILL HELP US WITH THIS PROBLEM?

  1. Well, if you want phone, cable, and internet, someone has to pay the bill.

    But there is legal recourse.  An attorney can file a "lien" against any homeowner not paying, and the title is then "encumbered" and the owner can't sell until they pay off.

    Get a lawyer that doesn't cost much.  This isn't much of a legal issue.  Just type and file some papers.

Before the neighborhood takes over the association, be sure to send certified letters requesting the current boards efforts to date to collect this money, including any liens that have been placed.  Give them 10 days to respond.  They have a responsibility as the paid management of the current HOA to follow-through & act in the best interest of the community.  If they have shirked this responsibility & plan to dump it off on you all in 2 months, they must be held accountable.  In most cases, there is legal recourse against mgmt companies that don't do the job they were paid for.  Get a copy of the Declaration of Covenants and consider bringing in an attorney, and by all means - get that letter out to them asap & start documenting EVERYTHING with these people.
