Taking points for a friend?

a very close friend of mine has asked me if i would take 3 points for him (sp30) as he would get banned and my licence was clear, i know he would do the same for me and i know people are going to say he is better off the road, but that is not true as he got 4 points which i know for a fact he did not deserve as i was in the car.

my main worry is..... my insurance policy does not cover me to drive another vehicle 3rd party despite the rumours, so if i do take the points are the police likely to check i was insured on the vehicle. it was a rear facing camera.

  1. If he was a friend he would not ask you to take the blame for his criminal actions.

    You could find yourself being charged for perjury , atempting to pervert the course of justice , driving without insurance , speeding and other offences if the vechile was defective in any way ( bald tyres , no mot etc)

    Tell him no !


  2. Don't do it.   You could be facing far more legal problems than simply points on your license including, if found out, a charge of "attempting to pervert the course of justice."    And that carries jail time.

    tell your so call friend to learn to drive .

    Everybody is happy to cover the total costs until they actually have to pay.

    Why don't you call your insurance company to find out how much extra you will have to pay, and for how long.

    What if by bad luck you happen to get another ticket?

    Whose going to take the fall for you?

In order for you to get the points, your friend will have to declare officially that you were the driver of the car at the time of the offence.  You will then be contacted and asked to confirm that you were driving and then you will have to produce you licence and your insurance document, to show that you were driving the car legally.

    If you are unable to produce a valid insurance document then you will be charged for driving without insurance, fined and given an endorsement of between 6-8 points.  You will then have 9-11 points on your licence.

    I am answering this question as you have asked.  I do not judge.  I know what my answer would be.  It is your choice.

    My advice would be to check absolutely with your insurer and if you do not have third party cover for driving another vehicle then be honest with your pal.  It is a straight choice he gets 7 points on his licence versus you get minimum 9.  I think he will probably understand, and not ask you to put so much on the line...

  6. You are in no position to say whether he deserved those 4 points or not, thats not your job and you are not trained to judge.

    Why do you  think you have better judgement than the law enforcement agency that gave him 4 points ?

    No, the police will not check your insurance.

    Or maybe they'll change the law within the next 3 years...do you fancy wondering whats in those white envelopes every morning for 3 years ?

    Once you break the law for him, it could escalate. He has you over a barrel for life. And, like it or not, there is every reasonable chance that a tiem will come when he will not be your close friend. Then where will you be ?

    Do you really fancy driving completely within the speed limits for the next 3 years, just in case a ticket comes your way ?

    I've got 3 points, they are due up next April, believe me, if you have any sense of responsibility you will hate it, watching all the cameras, cop cars and vans carefully just so you don't get another ticket.

    EDIT: Sorry, but he is just telling you what you want to hear, he cannot possibly agree to "cover costs for everything plus a bit extra"

    what about a driving ban for you ?

    He can't possbily agree to something when he doesn't even know the consequences, he's just trying to persuade you.

    What you are suggesting is a criminal offence, punishable by a jail sentence.  By the sound of it, it's what you both deserve...

  8. Quite possibly, and if it is found that you don't have insurance, you will face more points, and even a ban.

    Also, will your friend be paying the increase in your car insurance for the period that you have the points?

    I have heard of people in the past taking point for people but that was always when they have been insured on the vehicle. e.g. Company Vehicle, Girlfriend etc.

    Your 'friend' pressumably has either 10 points already or is a new driver.

    If it gets to the situation where one more speeding offence and you get banned, then the person should have been more careful.

    If they have 10 points they must have 2 speedings (or whatever) already plus the ditch eposide, so haven't really learnt their lesson.

    As others have said if they check that you were insured on the vehicle that is a serious offence and you could end up with a massive fine and/or ban yourself.

  13. I admire your attempt at loyalty, but you know as well as anyone else your friend deserves what he gets.

    What position are you in to determine whether he 'deserved' the 4 points to which you refer?  If you know the law that well you wouldn't be asking this question anyway.

  14. i would advise you to decline your friends suggestion

    as soon as you admit to the speeding offence they will ask if you are insured on the vehicle due to the car not being yours, you will be asked to procude your documents a you will get an in10 (driving without insurance)

    so you would not be getting 3 points you will get at least 6

    the after effect of this is you will see your insurance premiums jump as an in10 is seen as a very serious offence

    and together with the sp30 they basically will bump up your premiums as they could be trying to get rid of you as they think your a high risk driver

    ow and on top of this if your caught you and your friend could both be done for fraud so please dont say yes!

  15. Don't do it. What will happen when he gets the next three points?? If he's been caught he should take what's coming.

    Your friend should learn to drive properly or at least know to slow down when approaching a camera!

    If your friend was wrongly penalised 4 points then he should take the matter up legally to have them removed.  If the DVLA consider them valid then perhaps he SHOULD be banned and take a retest to get his licence back.

  17. Don't do it.  He is just gonna bet more ticket and get banned anyway.  If he hasn't changed yet, he isn't gonna change after this.

    He was WRONG to ask you to do this - not you for refusing.
