Taking someone to Small Claims Court

My friend is trying to get out of a really bad relationship (they are not married). They guy is on her checking account (already know that was a bad idea) and they bought a car together (another bad one) but he refused to put her name on the car, she put $3,000 down towards the price of the car, can she take him to small claims if he doesn't agree to give her the $3,000.00 she put towards the car?

  1. Possibly; he should check with city offices to see what the monetary level is to qualify as a "small claim."  Presuming he has the car in his possession, why is he being a jerk about giving her her money?


  2. Close the checking account.  She can take him to small claims court but may not win.  She'll have to prove she gave him $3000 and that it was a loan.  Does she have any emails, etc. which support that it was a loan?  He will probably say she either didn't give it to him or she did but it was a gift.  

    Without evidence, she'll probably be out the $3000.  

    Don't mean to be harsh but we've all learned that sometimes you have to pay a "stupid" tax.
