Tape recording in New York City?

My husband and I are trying to get sole custody of my 3 year old step son. He told us on numerous occasions that his mother hits him with a belt, demonstrate how she does it, and showed us where ( on his buttocks). CPS was called and OFCOURSE nothing was done. Does anybody know if I can tape record him saying this and use it as evidence of her abuse? The woman even said IN FRONT of my husband and I that she hits him (she didnt say with a belt she just warned my Step Son that if he acted up he was getting POW POW *Dominican way of saying an *** whooping*), but yet we feel no one believes us. Help!

By getting the step son saying what she does to him isnt going to be worth much.

When CPS is called they look for evidence that any harm was done to the child. If they see that no visible signs of abuse was done they wouldnt proceed.

Hitting with a belt on the butt is not illegal in the United States. I member my mom usto tell me PUM PUM meaning your going to get hit not an *** whooping.

That is NOT evidence! Personally, I can see nothing she has done wrong and neither has CPS. Parents have the right to spank their kids. I was spanked with a belt when I was a child. Didn't kill me!
