Tax question.. Should I fill out an SS8?

Some people at work are filling out ss8 forms and are trying to convince others to do the same. We work at a day spa and most of us get paid commission only. (A very low percent by the way). We are on a K1 as far as tax forms. Those who choose not to be paid commission, get hourly pay. They are on a 1099 tax form. We get to choose if we want hourly or commission pay but once we choose commission we can't change back to hourly. (If that info helps)

What will filling out an ss8 do? Can I get into trouble or even fired if I fill one out?

  1. If you are doing the same thing as others that have filed an SS-8 you can wait until they receive a response or file your own.  Based on your narrative, it is transparent that you all are employees.  Someone should contact your state unemployment tax agency explain how many people are employed and ask it for a ruling.    


  2. Which kind of K-1?  Did the spa actually make you limited partners or shareholders?
