Tax question about injured spouse form?

I did not make any income for 2007 but our economic stimulus check was 100% taken for a debt only in my husbands name wouldnt I be entitled to receive at least half of it for myself and our kids????

  1. If you file the Form 8379, you will receive 1/2 of the total stimulus rebate that you would have otherwise been entitled to.

    If you are only filing the Form 8379 to receive your split on the rebate, fill out Part I and Part III only.  Don't bother with Part II.  Write "Stimulus Rebate" in the white space on the top of the form and mail it in.  Figure about 8 to 14 weeks for processing, but you will receive 1/2 of your rebate eventually.

    Unlike with filing the form for apportionment of a tax refund, the state where you live doesn't matter for the rebates.  You'll automatically receive 1/2 of the total rebate due based upon the joint return that you filed.


  2. What state do you live in?  Did you file an injured spouse form?

  3. Was the injured spouse form filed with your tax return? If so, call the IRS at 1-800-829-0582, extension 726, as they will have to do an internal referral to get it corrected. If not, file the form per the instructions in another post.

  4. Yes, his whole reFUND would be taken since it was all due to his income and withholding, but you should have gotten half of the stimulus payment if the injured spouse form was properly filed and processed.
