Question:

Tax return for I-485

My wife doesn't have any income but her dad is the co sponsor. So we filed both the I-864 for my wife and the I-864A for her dad. Today the USCIS has asked us to include a tax return for my wife even though we filled $0.00 in the income amounts on the I-864.

Any help How we can deal with this issue?

Because of this reason my I-485 is not moving forward but i have given my biometrics two weeks ago. Is the tax return issue gonna affect getting my EAD?

  1. As long as her father is a co-sponsor and has sufficient funds.  The information for the I-864 does state that you need to submit the transcript for the tax return or provide an explanation if it is not submitted.  If you submitted an explanation for the ommission, you may want to contact them.  Otherwise, just contact the IRS and get the transcript for her return sent/faxed to you so that you can send it on to the USCIS.

If the problem is that your wife didn't file a tax return, you would just need to contact them and probably submit an explanation in writing that she didn't file a return.  If she did file, even with no income, it's just a matter of collecting and sending along one more piece of paperwork.

Since the tax return is for the I-864 and I-485, it shouldn't affect any application you've made for an employment authorization.
