Teen Driving Question?

California State law requires a year minimum of driving before you can sit other passengers under the age of 20. If I do carry passengers under the age of 20 and some one rear ends me who's fault is it?

  1. Both of you will cop consequences.  For you maybe a fine or license suspension and the other guy may have the same.


  2. im from NJ and if that happened and the cops got involved...thats a problem...license suspended and fine...dont they have a website like motor vehicles california that has a list of penalties ?

It depends, the other driver's insurance company will probably not want to accept 100% responsibility because you were violating motor vehicle law and shouldn't have been on the road if those other passengers were with you.  Whether they are successful in this or not is a toss up.  You will also have to answer to your violation in court and pay any fines and accept any other administrative "punishment" that goes along with it, like possibly having your license suspended or revoked in accordance with state law.

  4. the other driver's fault.  

    you will still get a suspension for the infraction.

  5. cops will consider it your fault because you shouldnt be driving in that condition and they ll take away your permit and you have to wait 6 months to get it back
