Temporary custody question, plz help me and my baby?

about 8 months ago i was in a financial struggle and could not provide sufficient financial support to my daughter (18 months old) so i talked with my mother and we decided it was best to give her temporary custody of my daughter until i was back on my feet and able to provide for her. Now i am but the agreement stated that i live at the same residence for at least 6 months and i am now going on 5 months, my mother sells pot and drinks now while watching my baby! i have called the cops and told them this but they cant do anything (like search the house). The parental father just established dna with my daughter and i was wonderng if he goes with me and my fiance to thesheriffss office and says he, as her parental father wants custody returned to me will it work? we also have drawn up a notarized letter stating that he wants me to retake full custody of her and provide for her, can we use this info or what? How can i get her back by using these resources and not go to court? it is for her own safety that we get her back now, and my mother iskeepingg her from me, just to be a b****. plz help? thank you a lot!

  1. you need to talk to a lawyer. the baby's father may have to try and get temporary custody or maybe co-custody of ya'lls daughter. the temporary custody you gave to your mother may have backfired on you.


  2. You will have to file a petition with the courts to try to get full custody back.  I don'tt believe that going to the Sherriff's office will do you any good. You already have a legal document stating that your mother has temp custody.  I would try to talk to her, or call the attorney that handled the papers for the temp cust. and see what your rights are.  

    I have to as, has your mother just recently started to selling pot and drinking?  Why would you let her have any type of custody if she was doing this before???  If she has just started this behavior within the last 5 months, Get an attorney!

  3. If the document wasn't filed with the court you have the legal right to pick her up.  If your mom doesn't want to let you take her call the sheriffs department and they will inform your mom to hand her over.  Good luck hope you get your daughter back
