Question:

Tenant Laws Regarding Renovations?

I'm in California and my apartment complex has been doing MAJOR renovations for over a month now. From 8am to 6pm, M-F I have to deal with contractors coming in and out of my apartment, banging, pounding, drilling, etc I work nights and have a 3 month old baby, so this has made it impossible for either of us to sleep. Scaffolding has kept me from parking in my assigned space. A note was left on our door at 8pm stating that everything must be moved 4 feet away from ALL WALLS by the next morning because all the windows were being replaced. Nice advanced warning! I don't even feel comfortable walking around my own apartment and it doesn't look like this c**p will be ending anytime soon. I can't live like this anymore!!!!!!! What can I do? What are my rights?

  1. .   The theory is that your life is worse now but better later with new windows and paint.  Not much you can do.  In a future lease you could write that construction that lasted more than 4 days would be grounds for you to terminate your lease.

  2. I hardly think there have been workmen in and out of your apartment daily for the last month.Exaggerating the situation does your argument no good.

Before demanding rights and suing anyone, have you simply went to the management and asked to be released from your lease without penalty? That's always a first step.

"Normal people" are away in the daytime... Normal construction hours are in the daytime... When do you expect them to work? Most people complaining about slumlords would relish workmen "annoying" them for a while.
