Can I evict my tenants for paying rent late

ok , new tenants moved in june 2008: first appointed rent payment was paid late and the reason was the bank did not pay it in to my account vi direct debit, now the 3rd month rent has not been paid into my account,. In the contract the rent is paid on the 9th of each month.

This month the 9th fell on a Saturday, but it's monday now andstill no rent in my account.

I have told them about this and feel I want to give them a written warning stating if any further late payments will lead to termination of the contract. Will I be able to keep the deposit as they have broken the terms in the contract. I am in United Kingdom. Any help will be great! oh the contract is a Assured shorthand tenancy

  1. i agree with greener.  and i don't know how things work in the uk BUT in the good ole us of a ... you can't just automatically evict someone if they are late on rent payment ... AND esp if you didn't state it in the lease agreement ... if you stated in the lease agreement that they have to pay a late fee now that is a different story.  so just sit back and relax ... even mortgage companies except late payment ... you just get penalized for it  


  2. The deposit is to cover damages in the apartment, it cannot be kept unless it is used to repair damages done to the apartment, even if they are late and not paying.

    I think you have a good idea about giving them a written warning if you want to evict them soon.

  3. FIRST OFF calm down! ever heard the old saying you catch more bee's with honey than salt??!! give them a 5 day grace period. These days its hard to get a tenant to even pay rent so be luckey your getting paid. If they are good people and you have rent automatically set up then calm down you will get your money. Putting them out on the street bc of being 2 days late on payment and over analyzing the situation is not going to solve anything, except you really wont get paid then and its just bad karma. It could be worse. they could not pay at all, nor speak to you and then youd have to go thru the eviction process. should i continue?
